AGREEMENT

On Border Cooperation between the National Security Service at the Government of the Republic of Armenia and the Ministry of Internal Affairs of Georgia

The National Security Service at the Government of the Republic of Armenia and the Ministry of Internal Affairs of Georgia (hereinafter referred to as the Parties)

Basing themselves on the Treaty of Friendship, Cooperation and Mutual Security between the Republic of Armenia and Georgia of October 23,2001;

Being guided by the universally recognized principles and norms of international law; desiring to develop friendly and equitable mutual cooperation between the Republic of Armenia and Georgia in border sphere;

Confirming their aspiration to develop cooperation and determine cooperation principles within their competence and in accordance with legislation existing in their countries;

Realizing the importance of international cooperation for prevention of organized cross-border crime, international terrorism, smuggling, trafficking, illegal migration and other illegalities

Have agreed as follows:

Article 1

In view of mutual interests and in accordance with the national legislation, the Parties shall cooperate in following directions:

1. Regular exchange of state border protection-related information of mutual interests;

2. Fight against state border trespass; illegal migration; trafficking; international terrorism; organized cross-border crime; smuggling of arms, ammunition, explosive, narcotic and psychotropic substances; radioactive materials; cultural and historical values; banned goods and items, as well as other illegalities at the state border;

3. Exchange of experience related to organization of state border protection and border control measures;

4. Operational-search activity in conformance with the state border protection interests.

Article 2

Parties shall, based on present Agreement, ensure due exchange of border protection - related information of mutual interest, including legislative and other legal acts facilitating the protection of state border regime.

Parties undertake to provide each other with information on parties* State citizens, foreign citizens, stateless persons, arrested for illegal crossing or crossing attempt of the state border of either State of the Parties, including through the border crossing checkpoints.

The rule of information exchange between the Parties shall be defined in a separate protocol that shall be an integral part of this agreement and shall enter into force in accordance with the Provisions of the article 8 of this Agreement.

Parties shall preserve confidentiality of information shared to each other, shall not in way use it to the detriment of each other's interests and shall not transfer it to the third party without written consent of the Party disclosing the information.

Article 3

The issues related to protection of state border regime shall be settled by the border agencies of the Parties through border representatives.

The issues related to the State Border Regime shall be defined by bilateral agreement between the Parties.

Article 4

The Parties undertake, within their authority, to extensively facilitate the settlement of Armenia-Georgia state border delimitation issues.

Article 5

Any disputable issues arising in course of implementation and interpretation of this Agreement shall be settled through negotiations and/or consultations between the Parties.

Article 6

The provisions of this Agreement shall not affect the commitments imposed upon the Republic of Armenia and Georgia under other international treaties.

Article 7

This Agreement can be amended by the consent of the Parties which shall be formulated by a separate protocol, which shall enter into force in accordance with Article 8 of this Agreement and shall constitute an integral part hereof.

Article 8

This Agreement shall enter into force on the date of the last notification conforming that the Parties have fulfilled their internal procedures, prescribed by their national legislation, for the entry into force of it and shall be in force for an indefinite period of time.

This Agreement can be terminated by any of the Parties notifying the other Party via diplomatic channels six month before.

Done at Tbilisi 29 of November 2011, in two originals in the Armenian, Georgian and English languages, all texts being equally authentic. In case of divergence of interpretation of provisions of this Agreement by the Parties, the English text shall prevail.

The Agreement has entered into force on 28.02.2012.
