ON APPROVING THE GUIDE FOR ORGANISING CONSTRUCTION WORKS AND ENSURING SAFETY AT A CONSTRUCTION SITE
Taking as a basis point 37 of part 3 of Article 10.1 of the Law "On urban development",
I hereby order:
1. To approve the Guide for Organising Construction Works and Ensuring Safety at a Construction Site, pursuant to the Annex.
2. This Order shall enter into force on the day following the day of its official promulgation.

GUIDE
FOR ORGANISING CONSTRUCTION WORKS AND ENSURING SAFETY AT A CONSTRUCTION SITE
1. SCOPE OF APPLICATION
1. This Guide shall establish the general requirements for the works for organising construction production in the course of new construction, as well as capital renovation (reconstruction, restoration, reinforcement), expansion, modernisation of existing buildings and constructions (later referred to as "the Construction") that are carried out in the territory of the Republic of Armenia; the general requirements need to be applied by the entities engaged in urban development activities.
2. The regulations prescribed by this Guide were developed within the scope of the main provisions of the Law "On urban development"; the Labour Code; the requirements of construction norms HHShN 13-02-2022 "Safety Equipment in Construction" and HHShN I-3.01.01-2008 "Execution of Works for Organising Construction Production" and the Methodical Consultation of the Chairperson of the Urban Development Committee of the Republic of Armenia No 09-A of 9 February 2023, etc.
2. OBLIGATIONS OF EMPLOYER/CLIENT/DEVELOPER/CONTRACTOR
3. Employer who is a participant of urban development activities (client/developer/contractor (hereinafter referred to as "the Employer") shall be obliged to:
(1) ensure involvement of workers (labour staff) in the process of organising construction production (at the construction site) on a contractual basis, provided that the employees have attained the age of 18 and have passed medical examination;
(2) ensure required fencing of the construction site (protective, defensive, signal), equipping with video-recording device, establishment of a geographical indication framework, construction of approach roads, creation of storage facilities and preparation of temporary buildings and constructions required for organising of construction production and life support of workers, masking of ground surfaces, instalment of a special panel with legible fonts (in Armenian, English, Russian) and content in an area that is more visible and accessible — with information regarding the data of the Employer Organisations (name, e-mail address, phone number), name and specific purpose of programme, terms of launch and end of construction works, construction permits (design and construction);
(3) ensure that workers are informed orally (also in English, Russian or other foreign language, upon necessity) about the launch of works and danger zones, the existing risks and security requirements, instruct by co-ordinating and supervising the whole process. Ensure awareness-raising and instruction by the specialist certified by the contractor (engineering-technical staff, including technical supervisor) and record the results of awareness-raising in the log book;
(4) ensure conduct of a course on work-specific security equipment for workers in the workplace, with the available professional resources and the involvement of qualified specialists and specialised organisations;
(5) ensure ongoing training of workers, testing of knowledge and training on task-specific security equipment (organise training also in English, Russian or other foreign language, upon necessity);
(6) prohibit workers not having received instructions and not having passed test of knowledge about security equipment from working independently;
(7) provide workers with the technical and personal protective equipment required for implementation of the technological process, including outerwear;
(7.1) carry out the special works — enshrined in Order of the Chairperson of the Urban Development Committee of the Republic of Armenia No 21-N of 26 August 2022 — through the formulation of a work order-permit (in Armenian or English or Russian), pursuant to the template;
(8) adjust — prior to the launch of earth work and with warning signs and line-markings — the deployment of engineering communication channels, danger zones, axes of underground structures and communication channels in the premises, as well as the schemes for movement of transport and pedestrians, ensuring safety of entrances and approaches, restricting the entry of outsiders with warning signs;
(9) provide the area of the construction site with complex protection measures (fencing, lighting, air conditioning, protective and braking devices, sanitary facilities and equipment (changing rooms, clothes and shoe dryers, bathrooms, shower rooms, spaces for catering and rest and medical centres);
(10) ensure — in case of reconstruction works — monitoring of data of examination of the technical condition of constructions, vehicles and communication channels, equipment, conditions for implementation of dismantling and construction-assembly (upon the necessity to exclude contamination caused by natural gas and dust, as well as the fire and explosion hazard and loud noise and to apply preventive measures);
(11) develop, jointly with person carrying out construction (subcontractors) in the work stations — with the involvement of subcontractors — an action plan for ensuring occupational safety which is mandatory for all organisations and persons participating in construction;
(12) ensure that all persons located at the construction site wear a helmet attached with a chinstrap, not allow workers to complete works without helmets or other necessary personal protective equipment;
(13) for maintenance of lifting cranes, designate — by an order — crane operators, designate their assistants, ropers and locksmiths, and for maintenance of lifting crane with electric propulsion — also electricians, the work-related orders of the specified specialists must be formulated after organising the training and testing of knowledge of the latter and after they obtain professional qualification;
(14) ensure that the lifting cranes, removable hoisting equipment are in good order and that they are safe for operating, by organising regular technical inspections and the services for repair and maintenance, via the technical officer and internal regulations within an organisation;
(15) provide technical officers and the maintenance staff with the instructions, methodical manuals and other regulatory documents about operating lifting cranes safely;
(16) prohibit the operation of lifting crane, if:
a. the particular lifting crane is not registered as prescribed by the legislation in the register of hazardous production facilities, has not been subjected to expert examination, inspection, testing, diagnostics and technical maintenance;
b. it is maintained by a crane operator who has not undergone training and lacks professional qualification;
c. persons who are responsible for safely operating a lifting crane are not designated during the transfer of loads;
d. a number of shortcomings have been detected on a lifting crane which may pose a risk to safe operation thereof.

3. OBLIGATIONS OF WORKER
4. Worker shall be obliged to:
(1) follow the guidelines and instructions of the Employer, ensure own safety, as well as the safety and health of colleagues directly associated with the work (as well as outsiders and passers-by). Perform the task in the area that is directly intended for that task. Observe and follow the safety equipment rules, be informed about the warning content and restrictions on conditional safety signs;
(2) wear special outerwear and other personal protective equipment. Work in conditions of sufficient lighting. Ensure, while working, distance from people and the tools and gadgets used thereby, provisional fences, mechanisms, forklift trucks, ropers, loading devices and loads;
(3) immediately inform the Employer about a potential hazard at the construction site, which may pose a threat to human health or life, terminate construction works, if there is a risk of accident, technical malfunction, impossibility or high risk of performance of works due to drastic change of weather, as well as insurmountable health problems;
(4) rule out the use of alcoholic drinks, psychotropic drugs and narcotic drugs during working hours;
(5) provide the Employer (technical supervisor, officer) with occupational safety measures, including in special conditions (at an altitude or depth, in winter and on-duty period) in accordance with the instructions and design solutions, governed by the special regulations prescribed by the construction norms "Safety Equipment in Construction" approved under Order of the Chairperson of the Urban Development Committee of the Republic of Armenia No 21-N of 26 August 2022.
4. APPLYING LIABILITY MEASURES AGAINST CONTRACTOR AND TECHNICAL SUPERVISOR
5. The following liability measures may be applied against the contractor and technical supervisor:
(1) liability measures under the Administrative Offences Code;
(2) liability measures under the Law "On liability for offences in the field of urban development";
(3) liability measures under the Civil Code;
(4) liability measures under construction work contracts, in accordance with the provisions of Methodical Consultation approved under Order of the Chairperson of the Urban Development Committee of the Republic of Armenia No 09-A of 9 February 2023.
